FOWLER CITY COUNCIL CONSIDERATION OF THE APPEAL OF THE PLANNING COMMISSION’S APPROVAL OF
SITE PLAN REVIEW NO. 11-03 FOR MOTEL 6

NOTICE IS HEREBY GIVEN that on Tuesday, March 6, 2012, at 7:00 p.m. or as soon thereafter as the matter can be heard, the Fowler City Council will hold a public hearing at the City Hall Council Chambers at 128 S. 5th Street, Fowler, California to consider the following matter:
Appeal of the Approval of Site Plan Review No. 11-03 for Motel 6 (Fowler Development, LLC): The applicant proposes to construct a 3-story Motel 6 with 81 rooms on a one-acre site located on the west side of 10th Street between Fresno Street and Main Street (APN 343-201-05). The site is located in the Form Based Code district and motels are permitted by right subject to site plan approval in accordance with Article 26 of the Fowler Zoning Ordinance. The proposed site plan includes building layout, parking and landscaping areas.
The Fowler Planning Commission held a public hearing on the site plan on December 15, 2011, continued to January 5, 2012 due to lack of a quorum. The public hearing was held pursuant to Section 9-5.26.03.H of the Fowler Zoning Ordinance which states that when, in the opinion of the Director, the site plan submitted is of such consequence or involves potential public controversy, the Director may refer the site plan to the Planning Commission for public hearing. At the January 5, 2012 continued hearing, the Planning Commission approved the proposed site plan but did not allow street parking on 10th Street to be considered as part of the parking requirement for the motel, requiring revision of the site plan to include additional off-street parking. The decision of the Planning Commission was appealed to the City Council by Gilbert Zavala, Attorney at Law, on behalf of Earnest Mata and other neighborhood residents. The City Council may uphold the decision of the Planning Commission approving the site plan; approve the site plan as originally proposed; deny the site plan and require a revised site plan to be submitted; or request additional information from the applicant justifying the project as proposed.
Environmental Determination - CEQA Class 32 Categorical Exemption – Urban Infill Development. The proposed project site is not listed in the Hazardous Waste and Substances Sites List pursuant to Government Code Section 65962.5(E).
The City Council requests your participation and the public is welcome to speak at the hearing. If you challenge the action in court, you may be limited to only those issues you or someone else raised at the public hearing, or in written correspondence delivered to the Community Development Department at, or prior to, the public hearing.
A staff report on this matter will be available to the public at least three days prior to the hearing and may be reviewed at Fowler City Hall located at 128 S. 5th Street. Any questions regarding this notice should be directed to Bruce O'Neal, City Planner, at 559/834-3113, ext. 122.
